Welcome to gks-erp.com (“the Site”), operated by gks Software, a sole proprietorship (“we”, “us”, “our”) registered in Greece. By accessing this Site or using gks ERP, you agree to these Terms of Use.

1. About gks ERP

gks ERP is open source business management software, released under the GNU General Public License (GPL). The source code is publicly available on this site and may be freely used, modified, and redistributed in accordance with the GPL.
The Site offers optional commercial services on top of the free software:

  • Pro License — a paid subscription that removes advertisements, enables automatic updates, and unlocks print templates for self-hosted installations.
  • Hosted Plan — a paid subscription where we host and maintain gks ERP on your behalf.

2. Free Software License

The core gks ERP software is licensed under the GPL. Nothing in these Terms restricts your rights under the GPL with respect to the source code itself. These Terms apply specifically to:

  • Your use of this Site (gks-erp.com)
  • Purchase and use of a Pro License
  • Purchase and use of the Hosted Plan
  • Any paid templates, support services, or other commercial offerings made available through this Site

3. Accounts and Purchases

To purchase a Pro License or Hosted Plan, you must provide accurate billing information. You are responsible for:

  • Keeping your license key confidential
  • Providing a valid site URL associated with your license
  • Ensuring your use complies with these Terms

We reserve the right to refuse or cancel an order at our discretion, including in cases of suspected fraud or abuse.

4. Pro License Terms

A Pro License is tied to a specific website URL as provided at checkout. The license:

  • Removes advertisements from your gks ERP installation
  • Enables access to software updates during the active subscription period
  • Unlocks Pro print templates

Licenses are non-transferable between unrelated domains without our written consent. We reserve the right to verify license validity periodically via automated checks.

5. Hosted Plan Terms

Under the Hosted Plan, we provide server hosting and maintenance for your gks ERP installation. This includes:

  • Server infrastructure and uptime monitoring
  • Software updates
  • Technical support as described in your plan

You remain the owner and controller of your business data. We act as a data processor for hosting purposes only (see our Privacy Policy for details).

6. Payments, Renewals & Refunds

  • Subscriptions (Pro License, Hosted Plan) are billed on a recurring basis as selected at checkout.
  • You may cancel a subscription at any time; cancellation takes effect at the end of the current billing period.
  • Refunds are available within 14 days of purchase in accordance with EU consumer protection law
  • Prices are listed in EUR and include applicable Greek VAT where required.

7. Acceptable Use

You agree not to:

  • Use the Site or paid services for unlawful purposes
  • Attempt to circumvent license validation mechanisms
  • Resell or redistribute Pro Licenses or Hosted Plan access without authorization
  • Interfere with the Site’s operation or security

8. Tax Compliance Disclaimer

gks ERP includes features designed to support compliance with Greek tax regulations, including myDATA transmission and MARK number generation through AADE’s systems. However:

You remain solely responsible for the accuracy of your tax filings and compliance with applicable Greek and EU tax law. gks ERP is a tool to assist with compliance; it does not constitute tax, legal, or accounting advice. We recommend consulting a licensed accountant for matters specific to your business.

We are not liable for penalties, fines, or losses arising from incorrect tax data entered into the software, misconfiguration, or changes in tax law that have not yet been reflected in an update.

9. Intellectual Property

The gks ERP source code is licensed under the GPL. All other content on this Site — including text, graphics, the gks ERP logo, and design — is the property of gks Software unless otherwise stated, and may not be used without permission.

10. Limitation of Liability

To the maximum extent permitted by law, gks ERP and this Site are provided “as is” without warranties of any kind. We are not liable for indirect, incidental, or consequential damages arising from your use of the software or Site, including but not limited to data loss, business interruption, or lost profits.

11. Changes to These Terms

We may update these Terms from time to time. Continued use of the Site or paid services after changes take effect constitutes acceptance of the revised Terms.

12. Governing Law

These Terms are governed by the laws of Greece. Any disputes shall be subject to the exclusive jurisdiction of the courts of Thessaloniki, Greece.
